Terms and Conditions
These Terms and Conditions govern all transactions between the customer and merchant, 49 Design. They should be referred to explicitly for guidance in handling and claim which may arise from said transaction.
We utilize USPS for nearly all shipments except bulk and wholesale. You order will NOT be shipped until your address is verified through the USPS system. You will be responsible for re-shipping charges if you fail to provide a correct USPS address. Providing an incorrect shipping address and having your merchandise returned to us DOES NOT afford you the option of a refund in any case. Merchandise you order that is returned to us will be held for 60 days maximum from the date of return receipt. If it is not claimed within 60 days, it will be considered abandoned property. You understand you forfeit all claims to your merchandise after 60 days and may not be able to have it reshipped after 60 days if you fail to provide a correct shipping address, pay for any levied shipping charges. We make custom items and manufacture one-of-a-kind items. Your order is a contract for us to make the items. A refund requires us to try to find someone with your size and color preferences which is not likely to happen, meaning we are left with unsellable product. Items made by one of our contracted manufacturers can take 3 to 4 weeks for delivery.
Our policy lasts 30 days. If 30 days have elapsed since you've received your purchase, unfortunately we can’t offer you a refund or exchange.
To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. You must also have a return authorization number approved by emailing email@example.com. Your return authorization number must be written on the package when you send it back. Merchandise sent to us with no return authorization will be returned to sender.
Several types of goods are exempt from being returned. Perishable goods such as food, flowers, newspapers or magazines cannot be returned. We also do not accept products that are intimate or sanitary goods, hazardous materials, or flammable liquids or gases. Used shoes are not refundable. Swimsuits and leggings are not refundable.
We also only provide refunds for coloring issues at our sole discretion. We DO NOT provide refunds for slight variations in color of items between your computer or mobile screen and reality. Perceptions of color are different between people and as with any printed item, your item may vary slightly from how it appears on your computer or mobile screen. We have noticed a huge perception difference among different people with the color red, and we will not be able to guarantee that because something has red in the name that it will match an individual perception of red. We use CMYK graphic coloring and a color in a name does not suggest that entire design may not contain many hues and shades of that color. Any refunds given for coloring will not include shipping.

To complete your return, we require a receipt or proof of purchase.
DO NOT send your purchase back to the manufacturer. All returns must be accompanied with a return authorization number which can be obtained by emailing firstname.lastname@example.org. Items returned without a return authorization will be returned to sender.
There are certain situations where only partial refunds in the form of store credit are granted (if applicable)
Book with obvious signs of use
CD, DVD, VHS tape, software, video game, cassette tape, or vinyl record that has been opened
Any item not in its original condition, is damaged or missing parts for reasons not due to our error
Any item that is returned more than 30 days after delivery
Refunds (if applicable)
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund or exchange. In most cases, store credit is issued.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 10 to 14 business days.
Late or missing refunds (if applicable)
If you haven’t received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next contact your bank. There is often some processing time before a refund is posted.
If you’ve done all of this and you still have not received your refund yet, please contact us at email@example.com.
Sale items (if applicable)
Only regular priced items may be refunded, unfortunately sale items cannot be refunded.
Exchanges (if applicable)
We only replace items if they are defective or damaged. Some items may be exchanged if they are the wrong size, however we do provide sizing measurements to ensure a proper fit for all items. You must be granted a return authorizations before sending your exchange. If you need to exchange it for the same item, send us an email at firstname.lastname@example.org for further instructions.
Are there any limitations on exchanges?
Yes. You may only exchange your item for the SAME ITEM within two sizes and only one exchange per order. We apologize, if your item is more than two sizes off from what you need, we will not be able to provide you with an exchange or refund. An item that is exchanged cannot be refunded, and only one exchange is allowed per item per order. We provide sizing and measurement charts on all items, and it is the customer's responsibility to ensure their measurements fall within the size needed.
You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
Depending on where you live, the time it may take for your exchanged product to reach you may vary.
If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item, and we are not responsible for anything you send that isn't insured or tracked if we do not receive it in original condition.
We reserve the right to cancel any order due to a technical error or glitch. Just because an order is placed does not mean we have accepted it. An order is not considered accepted until it is shipped. Any order may be cancelled for any reason by us should we not be able to fulfill it.
Customers are limited to no more than 4 clearance items of the same product. No exceptions can be made to this policy. If you order more than 4 items, your order may be cancelled for failing to follow our Terms and Conditions.
Customer agrees not to contact the 49 Design Social Media page about their order. Customer agrees if there are questions, comments, or concerns about their order to email customer service at email@example.com or if needing a return authorization to contact firstname.lastname@example.org.
Customer understands they will be banned from the 49 Design Social Media page for communicating about issues with their order with other 49 Design customers who are unrelated to them. The customer understands that the 49 Design Social Media page is unrelated in function to the ordering functions of 49 Design and is not run by any 49 Design agents who handle orders.
For residents of the United States, if your order has not been shipped with tracking within 60 days, you are entitled to a full refund. Residents of countries other than the United States, due to customs waits, are not entitled to refunds without the express written consent of 49 Design.
International customers, outside the United States, understand that they may incur taxes, customs duties, or other administration fees due to their order. 49 Design is not responsible in any way for paying these taxes, duties, or fees. Customers outside the United States may not receive a refund due to non-payment of taxes, duties, or fee.
All returns, exchanges, or refunds may incur a restocking fee depending on the nature of the return. 49 Design reserves the right to issue a restocking fee with any custom item to offset the cost of production.
Customer understands that filing a chargeback is entirely their right at any point of time. Customer understands that filing a chargeback means their merchandise becomes unpaid for upon filing a chargeback. Customer understands if they are in possession of unpaid-for merchandise at any time from 49 Design, a police report will be filed for the value of the unpaid-for merchandise and the customer's information including name, address, phone number, and email address will be provided to the police in order to recover unpaid-for property. 49 Design cannot be held responsible for arrests, charges, fines caused by the filing of police reports for unpaid-for merchandise. 49 Design reserves the explicit right to sue for damages caused by loss of property due to unpaid-for merchandise. Customer agrees and understand that all legal proceedings will be filed in the district court of Wichita, Kansas. International customers may have legal proceedings filed against them in their jurisdiction if 49 Design sees fit to pursue said proceedings. Customer understands they may incur court costs, fines, or penalties associated with legal proceedings. Customer understands 49 Design may pursue civil damages at its sole discretion if unpaid-for merchandise is not recovered, or is not returned in original condition.
